TERMS OF SALES OF MERCH.FR

1 – Introduction

These terms of sales are submitted between the company ENCORE MERCI (with a capital of 7623,00 € settled at 24 Rue du Champ de l'Alouette, 75013 PARIS and registered under the number n°342 053 519 at RCS from Paris) and every people or body corporate who whish to purchase through the website www.merch.fr (via these URL : www.boutique-kabaretkaas.fr, www.boutique-waxtailor.com, www.boutique-renaud.fr or www.boutique-skabazac.com).

The buyer recognizes that he knows everything about the terms of sales, and agrees with these.

2 – The Order

The order of products on www.merch.fr is executed in filling or sending an order form, through the Internet (www.merch.fr) or postal mail at this address : ENCORE MERCI 55/57, rue Brillat-Savarin, 75013 PARIS. The buyer must agree with the term of sales.The order will be confirmed in the best of time if the "email address" has been given by the user during its registration on merch.fr. By order confirmation the buyer accepts the presents terms of sales. This confirmation indicates clearly the references and the prices of the differents products, and the shipping cost.

3 – Payment

The payment from France is executed online by Paypal, credit card or French Bank Check in euros.

For the others countries, only Paypal payment is allowed.

4 – Prices

All prices which appears on the online-shop are TTC (all taxes included) in Euro.It takes in consideration the applicable VAT of the day of the order. ENCORE MERCI keeps the right to change its prices at anytime. Anyway, the right price is always the price established at the order's checking out.

The prices don't include the shipping costs which are at the buyer's expenses. The shipping costs will be indicate at the checking out. The possible fees, tax, or registration costs, customs duties are also at the buyer's expenses. The buyer has to do all the formalities.

5 – Products availability

Products suggested by the website www.merch.fr stays in sale until the buyout offer is online and in the limit of available stock. If a product is unvailable, ENCORE MERCI promises to keep the buyer informed by email.

6 – Delivery

The delivery is executed until up to 30 days as from the receipt of the order. The products are sent at the address indicated on the order form. ENCORE MERCI is not responsible for any errors. The delivery is considered done when the merchandise is first shown to the buyer. ENCORE MERCI is not responsible of undelivery or delay.
If the ordered product is definitly not available, the buyer will get a refund within 30 days.

7 – Exchange and refund

In the case of defective products delivery or or a mistake in the order, the buyer can ask for a refund (executed by ENCORE MERCI within 30 days from the reception of the returned product) or an exchange. ENCORE MERCI will take in charge all delivery fees.

8 – Cancellation clause
 
If the customer is not satisfied, he disposes of 7 business days from the reception of the products to take back his order and get refunds.
The items have to be sent back in their state, in their original packaging and accompanied by the invoice to the following address :

Incomplete, broken, used, smashed or dirty items can not be sent back. The customer will get a refund within 30 days from the product reception by ENCORE MERCI. The refund will be executed by Bank check formulated to the customer ordering and send at the billing address.

9 – Guarrantees

The products will benefit from legal guarantee of defects and latent defect.

10 – Retention of Title Clause

The company ENCORE MERCI keeps the property of the sold goods until the full payment.

11 – Intellectual property rights

All texts, illustrations, pictures and comments are laying by the Intellectual property rights. All uses without permission will be considered as counterfeiting.

12 – Personnel informations handling

All collected informations during the order are stricly confidential. It allows the handling of the order and will be used only for ENCORE MERCI activities . According to the law "Informatiques et Libertés" from the 6th January 1978, the buyer can, at any time, change or delete these informations. 13 – Assignment of jurisdiction

The terms of sale are subject to French law. All contestations will be subject to French authorities.
